Terms of Use and SMS Terms

These Terms of Use and SMS Terms (“Terms”) govern your access to and use of the website, online forms, text-messaging program, automated scheduling assistant, and other digital services operated by Whole Life Recovery Center, LLC (“Whole Life Recovery Center,” “WLRC,” “we,” “us,” or “our”).

By accessing or using these services, you acknowledge that you have read and agree to these Terms. If you do not agree, do not use the applicable website or digital service.

1. Scope of These Terms

These Terms apply to:

  • The Whole Life Recovery Center website;

  • General website contact and appointment-request forms;

  • Administrative text-message communications;

  • Our automated or artificial-intelligence-assisted scheduling system;

  • Appointment scheduling, confirmation, reminder, and rescheduling functions; and

  • Other administrative customer-service tools provided by WLRC.

These Terms do not replace or modify:

  • Our Notice of Privacy Practices;

  • Patient consent forms;

  • Treatment agreements;

  • Program rules;

  • Financial agreements;

  • Authorizations for the use or disclosure of health information; or

  • Rights provided by HIPAA, 42 CFR Part 2, or other applicable law.

When information is protected by healthcare privacy law, our Notice of Privacy Practices and applicable law control over any conflicting provision in these Terms.

2. General Information Only

The public information provided through our website, text-messaging program, automated scheduling assistant, or general administrative communications is offered for informational and scheduling purposes only.

Nothing provided through these services constitutes:

  • Medical advice;

  • Mental-health advice;

  • Substance-use-disorder treatment advice;

  • Diagnosis or clinical assessment;

  • A treatment recommendation;

  • A determination of eligibility or clinical appropriateness;

  • A guarantee of admission, enrollment, insurance coverage, or payment;

  • A substitute for consultation with a qualified healthcare professional; or

  • The establishment of a provider-patient relationship by itself.

A provider-patient or treatment relationship is established only through WLRC’s applicable intake, admission, consent, and clinical procedures.

3. Emergencies and Crisis Situations

Do not use our website forms, text-messaging number, automated scheduling assistant, or email address to report an emergency or request immediate crisis assistance.

These communication methods may not be continuously monitored and should not be relied upon for urgent care.

If you or another person may be in immediate danger or experiencing a medical or psychiatric emergency:

  • Call 911;

  • Go to the nearest emergency department; or

  • Contact an appropriate crisis-response service.

Administrative messages sent through our systems are not a substitute for emergency or crisis services.

4. Permitted Use

You may use our digital services for lawful purposes, including:

  • Requesting general information about WLRC services;

  • Asking to speak with a representative;

  • Requesting an appointment;

  • Selecting an available appointment time;

  • Confirming or rescheduling an appointment;

  • Receiving administrative appointment reminders; and

  • Addressing basic administrative customer-service matters.

You agree to provide information that is accurate and that you are authorized to provide.

5. Prohibited Conduct

You may not use our website or communications systems to:

  • Violate any law or regulation;

  • Impersonate another person;

  • Submit false, deceptive, or fraudulent information;

  • Harass, threaten, abuse, or intimidate any person;

  • Send malicious software, harmful code, or automated spam;

  • Attempt to gain unauthorized access to WLRC systems, accounts, or data;

  • Interfere with the operation or security of our services;

  • Collect information about other users without authorization;

  • Use the services for commercial solicitation or advertising;

  • Submit another person’s sensitive information without proper authority; or

  • Use our systems in a manner that could compromise patient confidentiality or safety.

We may restrict or terminate access to our digital services when we reasonably believe they are being misused.

6. SMS Program Description

Whole Life Recovery Center operates a non-promotional customer-care and administrative text-messaging program.

The program is used for two primary purposes:

  1. To respond to people who contact WLRC by text to request general information, schedule an appointment, or ask to communicate with a representative; and

  2. To communicate with currently enrolled individuals regarding appointment confirmations, reminders, scheduling, rescheduling, and related administrative service coordination.

The program is not intended for general advertising or promotional marketing.

7. How SMS Consent Is Obtained

You may consent to receive administrative text messages by:

  • Texting Whole Life Recovery Center directly;

  • Asking WLRC to communicate with you by text;

  • Providing your mobile number through an applicable consent process;

  • Requesting an appointment and selecting text messaging as a communication method; or

  • Enrolling in administrative appointment reminders.

When you initiate a text conversation, WLRC may respond to address the purpose of your inquiry.

Your SMS consent applies only to Whole Life Recovery Center’s stated administrative messaging program. It is not transferable to another business or unrelated messaging campaign. A2P guidance expects consent to be specific to the campaign and not hidden within unrelated terms.

Consent to receive text messages is not a condition of obtaining services from Whole Life Recovery Center.

You may request communication through another reasonably available method.

8. Types of SMS Messages

Messages may include:

  • Responses to an appointment request;

  • Available appointment dates or times;

  • Appointment confirmations;

  • Appointment reminders;

  • Rescheduling options;

  • Confirmation that a request was routed to a representative;

  • Basic administrative follow-up;

  • Requests to confirm your identity or contact information; and

  • HELP, STOP, or other required account-management responses.

Messages will generally be limited to basic administrative information such as your name, mobile number, appointment date, appointment time, and scheduling status.

9. Message Frequency and Carrier Charges

Message frequency varies depending on your requests, scheduled appointments, and interactions with WLRC.

Message and data rates may apply under your wireless service plan. Contact your wireless carrier for information about your plan.

Wireless carriers are not responsible for delayed or undelivered messages.

WLRC is not responsible for fees charged by your wireless carrier.

10. Opting Out of Text Messages

You may unsubscribe from the SMS program at any time by replying:

STOP

After you send STOP, you may receive one final message confirming that you have been unsubscribed. You will not receive additional messages through that SMS program unless you later provide valid consent or reply with a recognized resubscription keyword, such as:

START

Opting out of text messaging does not cancel an appointment, terminate enrollment, or prevent WLRC from contacting you through another legally permitted method when necessary.

You remain responsible for contacting WLRC through another method if you need to confirm, cancel, or reschedule an appointment after opting out.

11. SMS Assistance

For assistance with text messaging, reply:

HELP

The responsive message may provide instructions for obtaining assistance from a WLRC representative.

12. Automated Scheduling Assistant

WLRC may use an automated or artificial-intelligence-assisted system to manage routine administrative text communications.

The automated assistant may:

  • Ask for your name;

  • Ask what date or time works for you;

  • Present available appointment times;

  • Confirm or reschedule an appointment;

  • Provide general administrative information; and

  • Route your request to a WLRC representative.

The automated assistant is not a clinician and cannot:

  • Diagnose a condition;

  • Provide medical or behavioral-health advice;

  • Recommend treatment;

  • Conduct a clinical assessment;

  • Make emergency or crisis determinations;

  • Provide individualized clinical guidance; or

  • Replace communication with an appropriately qualified WLRC professional.

Messages may be reviewed by authorized WLRC personnel for customer service, scheduling, privacy, security, compliance, quality assurance, or system administration.

13. Sensitive Information and SMS Limitations

Standard SMS messaging may not be encrypted or fully secure. Messages may be accessible to:

  • Anyone who has access to your device;

  • Members of a shared wireless account;

  • Your wireless carrier;

  • Device or cloud-service providers; or

  • A future recipient of your telephone number if it is reassigned.

HHS advises that personal mobile devices and cellular-service providers may store communications and related metadata, and information stored on a person’s device may fall outside HIPAA’s direct protection in some circumstances.

Do not send the following through ordinary text messaging:

  • Diagnoses;

  • Detailed mental-health or substance-use information;

  • Treatment records or clinical notes;

  • Medication lists;

  • Social Security numbers;

  • Insurance identification numbers;

  • Payment-card or banking information;

  • Photographs of identification documents;

  • Detailed medical histories; or

  • Other highly sensitive information.

If a conversation becomes clinical, sensitive, urgent, or inappropriate for standard SMS, the automated assistant or WLRC representative may direct you to another communication method.

Healthcare providers may communicate with patients about appointments, but they should limit disclosures and use reasonable privacy safeguards.

14. Your Responsibilities Regarding Contact Information

You are responsible for:

  • Providing an accurate telephone number;

  • Informing WLRC when your number changes;

  • Maintaining appropriate security on your device;

  • Preventing unauthorized access to your messages;

  • Reviewing appointment information for accuracy; and

  • Contacting WLRC if you believe a message was sent to the wrong person.

If you obtain a telephone number previously used by another person, notify WLRC and reply STOP if you do not wish to receive further messages.

15. Appointment Information

Appointment messages are provided as an administrative convenience.

You are responsible for:

  • Verifying the date and time of your appointment;

  • Arriving or participating as instructed;

  • Giving appropriate notice when you need to cancel or reschedule;

  • Following any separate program or attendance requirements; and

  • Contacting WLRC when you are uncertain whether an appointment has been confirmed.

A text confirmation does not guarantee admission, enrollment, transportation, insurance authorization, payment, or eligibility for a specific service.

WLRC may change or cancel appointments when operational, clinical, safety, staffing, weather, or other circumstances require it.

16. Privacy

Your use of our website and digital services is also governed by our Privacy Policy and, where applicable, our Notice of Privacy Practices.

Our Privacy Policy explains how we collect, use, retain, protect, and disclose information, including information connected with the SMS program.

No mobile information will be shared with third parties or affiliates for their own marketing or promotional purposes. Mobile opt-in information and consent will not be sold, rented, or transferred for third-party marketing.

A2P campaign reviewers examine publicly accessible Privacy Policy and Terms URLs, and Twilio requires these URLs for new campaign registrations beginning June 30, 2026.

17. Third-Party Service Providers

WLRC may rely on third-party providers for:

  • Website hosting;

  • Text-message delivery;

  • Telephone services;

  • Appointment scheduling;

  • Customer-relationship management;

  • Automated-assistant functions;

  • Data storage;

  • Security monitoring; and

  • Technical support.

Service availability may depend on those providers and on wireless networks outside WLRC’s control.

Use of a third-party platform may also be subject to that provider’s terms and privacy practices. However, service providers acting for WLRC are not authorized to use mobile opt-in information for their own marketing purposes.

18. Availability and Modification of Services

We may modify, suspend, restrict, or discontinue any website feature, communication method, automated-assistant function, or digital service at any time.

We do not guarantee that:

  • The website will always be available;

  • Messages will always be delivered;

  • An automated response will be immediate;

  • Appointment availability will remain unchanged;

  • Information will be free from technical errors; or

  • Every communication will be reviewed in real time.

A2P 10DLC registration is designed to support verified and consensual business messaging, but registration does not guarantee delivery of every message.

19. Website Content and Intellectual Property

Unless otherwise stated, the website’s text, branding, graphics, logos, layout, forms, and other content are owned by or licensed to Whole Life Recovery Center and are protected by applicable intellectual-property law.

You may view and print reasonable portions of the website for personal, noncommercial use.

You may not, without prior written permission:

  • Reproduce substantial portions of the website;

  • Modify or create derivative works from our content;

  • Use WLRC’s name, logo, or branding in a misleading manner;

  • Sell or commercially distribute website content; or

  • Remove copyright, trademark, or proprietary notices.

20. Third-Party Links

The website may link to services or websites operated by other organizations.

WLRC does not control and is not responsible for an independently operated third-party website’s:

  • Content;

  • Availability;

  • Accuracy;

  • Privacy practices;

  • Security; or

  • Terms.

A link does not necessarily constitute endorsement.

21. Disclaimer of Warranties

To the maximum extent permitted by law, the website and administrative digital services are provided on an “as is” and “as available” basis.

WLRC does not warrant that these services will be:

  • Uninterrupted;

  • Error-free;

  • Completely secure;

  • Free from harmful code;

  • Appropriate for every user; or

  • Sufficient for medical, clinical, crisis, or emergency purposes.

Nothing in this section limits obligations that WLRC cannot lawfully disclaim, including duties imposed by applicable healthcare, privacy, consumer-protection, or professional laws.

22. Limitation of Liability

To the maximum extent permitted by applicable law, WLRC will not be liable for indirect, incidental, consequential, special, or punitive damages arising solely from the use or inability to use its public website or administrative messaging tools.

This includes damages associated with:

  • Delayed or undelivered messages;

  • Wireless-network interruptions;

  • Device access by another person;

  • Incorrect contact information provided by a user;

  • Failure to review a message;

  • Reliance on administrative information as clinical advice; or

  • Use of the system for an emergency despite these Terms.

This provision does not exclude liability that cannot legally be excluded and does not waive any patient right or remedy available under applicable law.

23. Indemnification

To the extent permitted by law, you agree to be responsible for losses, claims, or expenses resulting from your unlawful misuse of the website or digital services, your intentional violation of these Terms, or your infringement of another person’s rights.

This provision does not apply to claims arising from WLRC’s own violation of law, negligence, professional services, or obligations that cannot legally be limited.

24. Accessibility

WLRC seeks to make its public-facing services reasonably accessible.

Individuals who have difficulty using the website or text-messaging program may contact WLRC to request an alternative communication method or reasonable assistance.

25. Children and Minors

Our public website may provide general information that can be viewed without creating an account. However, appointment requests and healthcare services involving a minor must be handled in accordance with applicable consent, custody, confidentiality, and healthcare laws.

A minor should not submit another person’s information or independently consent to communications when authorization from a parent, guardian, or other legally authorized person is required.

26. Changes to These Terms

We may revise these Terms to reflect changes in:

  • Our services;

  • Messaging practices;

  • Technology;

  • Legal requirements; or

  • Operational procedures.

Revised Terms will be posted with an updated “Last Updated” date.

Continued use of the website after revised Terms are posted constitutes acceptance of the revised website terms. Changes to SMS consent practices will be implemented in accordance with applicable law and messaging requirements.

27. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles.

Any legal proceeding concerning these Terms that is not governed by a separate enforceable agreement must be brought in a court of competent jurisdiction in Kentucky.

Nothing in this section restricts a person’s right to file a complaint with a governmental, licensing, privacy, civil-rights, healthcare, or regulatory authority.

28. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

29. No Waiver

WLRC’s failure to enforce a provision of these Terms does not waive its right to enforce that provision later.
